Welcome to Swakshamta EAP & Training Services (“Swakshamta”, “we”, “us”, or “our”). These Terms & Conditions govern your use of our website (swakshamta.in) and the services we provide. By accessing our website, making an inquiry, or engaging our services, you agree to these terms. If you do not agree, please discontinue use of our website and services.
About Our Services
- Swakshamta is a woman-led enterprise providing workplace wellbeing and corporate training services across three areas:
- Employee Assistance Programs (EAP) — confidential psychological counselling, stress and burnout support, crisis and trauma response, and workplace conflict resolution.
- EHS & ESG Corporate Compliance Training — safety, first aid, disaster management, and ESG-aligned compliance training.
- Quality Management System (QMS) Training — ISO awareness, Lean Six Sigma, Kaizen, TQM, and related programs.
- Specific deliverables, scope, duration, and fees for any engagement are defined in a separate written proposal, quotation, or service agreement, which takes precedence over these general terms in the event of any conflict.
Use of Our Website
- You agree to use this website only for lawful purposes. You must not:
- Attempt to gain unauthorized access to our systems or data;
- Copy, reproduce, or redistribute our content without written permission;
- Use the website in any way that could damage, disable, or impair its functioning;
- Submit false, misleading, or fraudulent information through our enquiry forms.
Bookings, Scheduling & Payments
- Service engagements begin only after a written proposal or service agreement is mutually accepted.
- Counselling sessions and training programs are scheduled by mutual confirmation. You will receive details such as date, time, and meeting link or venue in advance.
- Fees, payment timelines, and applicable taxes are specified in the relevant proposal or invoice. Payments are due as per the agreed schedule.
- Unless stated otherwise in writing, fees once paid are non-refundable, except where Swakshamta is unable to deliver the agreed service.
Confidentiality
Confidentiality is fundamental to our work, particularly within our EAP services. Information shared by individuals during counselling is treated as private and is protected in line with our Privacy Policy and professional ethical standards.
Limited exceptions to confidentiality may apply where disclosure is required by law, or where there is a serious and identifiable risk of harm to the individual or others. These exceptions are explained to participants as part of the counselling process.
Intellectual Property
All content on this website — including text, graphics, logos, training frameworks, the EQ Innovate methodology, course materials, and program designs — is the intellectual property of Swakshamta or its licensors.
Training materials provided during an engagement are for the internal use of the contracting organization and its participants only. They may not be reproduced, resold, repackaged, or distributed externally without our prior written consent.
Limitation of Liability
- To the fullest extent permitted by law:
- Swakshamta provides its services with reasonable skill and care, but does not warrant uninterrupted or error-free website access.
- We are not liable for any indirect, incidental, or consequential loss arising from the use of our website or services.
- Our total liability in connection with any engagement shall not exceed the fees actually paid to us for that specific engagement.
- We are not responsible for outcomes resulting from incomplete or inaccurate information provided to us, or from advice or training not being implemented as recommended.
